Random Apps informs you that access to and use of the ÓLIVER MÁNAGER App are subject to these Terms of Use, in order to comply with the obligations set out in Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), which is why we recommend that you read it. The user undertakes to use them in accordance with the provisions herein, as well as with the legislation in force at the time of use.

The "ÓLIVER MÁNAGER" application for mobile phones or other APPs (hereinafter jointly referred to as "the APP") is owned by Random Apps (hereinafter the Provider). This legal notice governs access to and use under the name ÓLIVER MÁNAGER, as well as the content, products and services made available to its users.

The Provider supplies the content and services available in the APP, subject to these General Terms of Use as well as the personal data processing policy (hereinafter the "Privacy Policy"). Accessing the APP or using it in any way gives you the status of "User" and implies unreserved acceptance of each and every one of these Terms of Use, with the Provider reserving the right to modify them at any time.

Consequently, it is the responsibility of every User to read them carefully each time they access the APP, so that, if they do not agree with any of the provisions set out herein, they must refrain from using it.

Likewise, you are warned that, on occasion, particular conditions may be established for the use of specific content and/or services; the use of such content or services will imply acceptance of the particular conditions specified in them.

The Provider offers the User a service for managing amateur football groups and supporters' associations in exchange for the unconditional acceptance of these terms and conditions of use.

In this regard, the User is informed that the voluntary creation of a profile in the ÓLIVER MÁNAGER APP implies knowledge and express and unequivocal acceptance of these Terms and Conditions of Use.

3. Provider's liability and force majeure

The Provider may interrupt the service or immediately terminate the relationship with the User if it detects that the use of its APP or of any of the services offered on it is contrary to these General Terms of Use.

This APP has been reviewed and tested to work correctly. In principle, correct operation can be guaranteed 365 days a year, 24 hours a day. However, the Provider does not rule out the possibility of situations of force majeure or fortuitous events that make access impossible.

In the event of maintenance, repair, updating or improvement operations on the services, the Provider has the right to temporarily suspend access to the APP without prior notice, as well as to reserve the right to provide or cancel the services, notwithstanding which it will endeavour to inform users, provided that circumstances so permit.

Therefore, the Provider does not guarantee continued access, nor the correct display, download or usefulness of the elements and information contained, which may be prevented, hindered or interrupted by factors or circumstances beyond its control.

The Provider is not liable for damages, losses, claims or expenses arising from the use of the APP, or for damages of any nature that may result from the lack of availability or continuity of operation of the APP and its services and the usefulness that Users may have attributed to it. It will only be responsible for removing, as soon as possible, the content that may cause such damages, provided it is notified accordingly.

In particular, it will not be liable for damages that may arise from, among others:

4. User obligations

The User undertakes to make appropriate and lawful use of the APP, of their profile and of the content and services, in accordance with the applicable legislation at any given time; the General Terms of Use of the Website; generally accepted morality and good customs and public order. In this sense, it is strictly prohibited to use the APP for any purpose other than the practice of amateur football; therefore, violent content of any kind is prohibited, from the mere display of weapons to sensitive images or explicit texts, as well as pornographic content. Likewise, it is prohibited to share, distribute, promote or facilitate content related to gambling and betting, as well as drugs or the misuse of controlled substances such as alcohol, tobacco and medicines. Furthermore, in ÓLIVER MÁNAGER, content that advocates terrorism, racism, sexism, or any other conduct that directly violates Universal Human Rights is prohibited.

The use of images or data of third parties without their consent is prohibited, as are humiliations, abuse or insults that, by any means and in any form, are perpetrated against third parties, thus protecting the right to honour, personal and family privacy, and to one's own image.

To provide truthful information when completing the forms contained in it with your personal data and to keep it updated at all times so that it reflects the User's actual situation.

The User will be solely responsible for any false or inaccurate statements they make and for any damages caused to the Provider or to Third Parties by the information they provide.

Notwithstanding the provisions of the previous section, the User must also refrain from:

Making unauthorised or fraudulent use of the APP and/or the content, for unlawful purposes or effects, prohibited in these Terms of Use, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload, impair or prevent the normal use of the services or the documents, files and all kinds of content stored on any computer equipment.

If, negligently or wilfully, the User breaches any of the obligations set out in these General Terms of Use, they will be liable for all damages that may arise from such breach for the Provider.

The User may cancel their registration in the APP by contacting ÓLIVER MÁNAGER by email at: olivermanageroficial@gmail.com.

5. Hyperlinks – Linking policy

The APP has technical linking devices (such as, among others, links, banners, buttons), directories and search tools that allow Users to access websites belonging to and/or managed by third parties.

If you access these links, you may communicate your data to the entities responsible for that platform or website. To find out how these entities use and process your data, we advise you to carefully read the privacy policies of those establishments.

6. Cookies

Óliver Mánager does not use cookies (small text files that the server sends to the computer of the person accessing the page); however, Google, as an associated provider through ADMOB, uses cookies to serve ads in the APP with which user data may be collected.

The user can disable the use of these cookies by following the instructions given in the advertising section of Google's privacy policy.

7. Intellectual and industrial property

The APP, including but not limited to its programming, editing, compilation and other elements necessary for its operation, the designs, logos, text and/or graphics, is the property of the Provider or, where applicable, it holds a licence or authorisation from the authors. All the content of the APP is duly protected by Spanish and international regulations on intellectual and industrial property, and is registered in the corresponding public registers.

This Legal Notice does not imply the assignment or transfer to the User of any intellectual or industrial property rights over the APP or over any of its constituent elements.

The User is expressly prohibited from carrying out acts of reproduction, distribution, transformation, public communication, making available, extraction, reuse, forwarding or exploitation by any means or procedure of the APP or its constituent elements, except in cases where it is legally permitted or there is express written authorisation from the Provider.

Any unauthorised use will be considered a serious breach of the author's intellectual or industrial property rights.

Designs, logos, text and/or graphics not belonging to the Provider that may appear in the APP belong to their respective owners, who are themselves responsible for any possible dispute that may arise regarding them.

To make any kind of observation regarding possible breaches of intellectual or industrial property rights, as well as regarding any of the content of the APP, you can send an email to olivermanageroficial@gmail.com.

The Provider expressly reserves any civil and criminal actions that may correspond to it as a result of the violation of the peaceful possession and/or unauthorised ownership of industrial and intellectual property rights.

8. Duration of the service, suspension and modification. Jurisdiction

Duration of the service, suspension and modification

The provision of the service is, in principle, of indefinite duration. However, the Provider may terminate or suspend any of the APP's services. Where possible, the termination or suspension of the provision of the specific service will be announced.

In the event that any provision of these General Terms of Use is unenforceable or void under applicable law or as a result of a judicial or administrative decision, such unenforceability or nullity will not render these General Terms of Use unenforceable or void as a whole. In such cases, the Provider will proceed to modify or replace such provision with another that is valid and enforceable and that, as far as possible, achieves the objective and intention reflected in the original provision.

Jurisdiction

These General Terms of Use, as well as the use of the APP, will be governed by Spanish law. Any dispute will be resolved before the competent Courts and Tribunals.

9. Privacy policy

Pursuant to the provisions of the applicable data protection regulations, all personal data provided through the corresponding forms during the use of the APP will be processed by the Provider as set out in the Privacy Policy.

The Provider will process personal data confidentially and in accordance with the applicable data protection regulations and will not disclose it to third parties unless necessary for the fulfilment of contractual obligations and by legal obligation.

Terms of use

These terms of use ("Terms") govern access to and use of the information society services that we make available to you as users of the Internet through the APP (in any of its forms, applications, etc. and for any type of device -fixed or mobile- through which the APP or Website is accessed), as well as, in general, the relationship between Users and the APP, subject to other particular or specific communications, conditions and instructions that are brought to your attention in each case.

Access to or mere use of the App in any of its forms implies adherence, as Users, to the Terms published at any given time in the APP and available to Users. Consequently, you must read these Terms carefully. At any time, you may save or print the Terms, and we advise you to do so.

Terms of use

ÓLIVER MÁNAGER offers the User a service for managing amateur football groups and associations (players, results, statistics, etc.), in exchange for the unconditional acceptance of these terms and conditions of use.

In this regard, the User is informed that the voluntary creation of a profile in ÓLIVER MÁNAGER implies knowledge and express and unequivocal acceptance of these Terms and Conditions of Use.

Conditions and limitations of use

ÓLIVER MÁNAGER is an entity committed to the protection of the personal data of its users, so within its organisation it has implemented technical and organisational measures in order to preserve the security and confidentiality of the data of the Users of the APP.

ÓLIVER MÁNAGER reserves the right to modify the content of the App at any time, without prior notice.

In the event of maintenance, repair, updating or improvement operations on the services, ÓLIVER MÁNAGER has the right to temporarily suspend access to the APP without prior notice, as well as to reserve the right to provide or cancel the services, notwithstanding which it will endeavour to inform users, provided that circumstances so permit.

In this way, any liability for damages of any nature that may arise from the lack of availability or continuity of operation of the App and its services and the usefulness that Users may have attributed to them is excluded.

The User

The User is entirely responsible for accessing and correctly using their profile, and therefore undertakes to use the APP, its content and services in accordance with the law in force, with this Legal Notice, and with the other notices and privacy policies brought to their attention, as well as with the principles of good faith, morality, generally accepted good customs and public order. And specifically, they undertake to diligently observe these General Terms of Use.

To this end, the User will refrain from using any of the services for unlawful purposes or effects, prohibited and harmful to the rights and interests of third parties.

Disclaimer of liability

Access to the App, as well as any use that may be made of the information it contains, is the sole responsibility of the user.

Given the particularities of the Internet, ÓLIVER MÁNAGER is not responsible for:

ÓLIVER MÁNAGER is not responsible for damages caused to Users as a result of the risks inherent to the medium used, nor for those caused by vulnerabilities in its systems and tools arising from a fortuitous event, force majeure or that is not directly attributable to the Company.

The user will be solely responsible for any infringements they may incur or for any damages they may cause through the improper use of the App and its services or content. The user will be solely responsible for any claim or legal action, judicial or extrajudicial, initiated by third parties both against the user and against ÓLIVER MÁNAGER, based on improper use of the App, its services or its content.

The Company does not guarantee the total security of its systems and, although it has adopted appropriate security measures, the existence of vulnerabilities due to force majeure or a fortuitous event cannot be completely ruled out and, consequently, caution must be exercised when interacting with the App.
